Kris Powell has a diverse litigation practice with an emphasis in complex commercial, business litigation, and products liability claims. This extensive experience includes prosecuting and defending cases in both federal and state courts. Kris also has significant experience with insurance matters and litigating disputes concerning insurance coverage. As a member of Bryan Nelson’s insurance coverage team, Kris routinely provides insurance carriers with legal opinions concerning coverage, litigates declaratory judgment actions on matters of defense and indemnity obligations, and defends insurance carriers from first-party contractual and bad faith claims.
His litigation background has included successfully obtaining the dismissal of a federal class action lawsuit filed against a large national insurance company arising in the aftermath of Hurricane Katrina, as well as successfully defending a large industrial equipment manufacturer from multiple property, contract, warranty and personal injury claims arising from an industrial accident which allegedly disabled plant operations for nearly a year. Kris has defended manufacturers of products against claims of defective products and inadequate warnings, and has represented a supplier of industrial products and gases in defending claims asserted by in excess of 10,000 plaintiffs alleging toxic exposure.
Kris has litigated matters through trial to judgment in both state and federal court, and has appeared for clients in the Court of Appeals of Mississippi, as well as the Mississippi Supreme Court. His litigation experience has involved highly complex matters, often involving claims with potential high exposure. Kris has counseled clients concerning the protection of confidential and proprietary information, and has litigated the enforceability of non-compete agreements, allegations of unfair competition trade secrets and deceptive and unfair trade practices
